The government’s Fair Work Legislation Amendment (Secure Jobs Better Pay) Act 2022 (“Legislation Amendment”) is changing laws relevant to workplaces, including changes to bargaining, agreement making, sexual harassment cases and registered organisations. These amendments introduced a sunset provision for pre-2010 workplace employee agreements for their automatic termination effective from 7 December 2023 unless an application is made to the Fair Work Commission before 7 December 2023 to extend the default period. Belgravia Health & Leisure Group (“Belgravia”) has a pre-2010 workplace employee agreement (the Belgravia Leisure Certified Agreement 2003) registered with the Fair Work Commission that covers the minimum employment terms of our employees.
In accordance with the Legislation Amendment, the Belgravia Leisure Certified Agreement 2003 (“the Agreement”) will automatically cease to operate from 7 December 2023, and Belgravia will not make any application to extend the validity of the Agreement beyond 7 December 2023. Once the agreement is terminated, the minimum terms and conditions for employees will be covered by their relevant industry award. We will communicate further with applicable employees in due course.
